4.2 Disclaimer regarding listings

HIFICafe does not verify, control, or guarantee:

• The truthfulness, accuracy, or completeness of the information contained in the listings
• The identity, solvency, or reliability of advertising or purchasing users
• The existence, quality, condition, safety, legality, or conformity of the listed equipment
• The legal title or availability of the products for sale
• The legal capacity of users to enter into purchase contracts

4.3 Exclusive user responsibility

All negotiation, agreement, payment, shipping, delivery, and any other action related to the purchase of equipment is carried out directly and exclusively between users, without any intervention by HIFICafe. Consequently:

• The seller is solely responsible for the content of their listing, the product description, its actual condition, and fulfilling delivery obligations
• The buyer is solely responsible for verifying the information, inspecting the product, and performing any checks they deem appropriate before any payment
• Both parties are responsible for agreeing upon and fulfilling the transaction conditions (price, payment method, shipping, warranties, returns, etc.)

4.5 No mediation in conflicts

HIFICafe will not mediate or arbitrate disputes arising between users. The parties must resolve their differences directly between themselves or by recourse to the competent courts or alternative dispute resolution mechanisms they deem appropriate.

4.6 Advertiser user obligations

The user who posts a listing declares and warrants that:

• They are the legitimate owner of the equipment or are authorized to sell it
• The equipment is not stolen, is free of encumbrances, and can be legally transferred
• The listing information is truthful, complete, and not misleading
• The photographs correspond to the actual product being offered
• They will comply with applicable legislation regarding private sales

4.7 Safety recommendations (without obligation for HIFICafe)

For informational purposes only and without creating any obligation for HIFICafe, users are recommended to:

• Verify the identity of the other user before closing a transaction
• Personally inspect the equipment before paying, when possible
• Use secure and traceable payment methods
• Be wary of offers with prices far below market value
• Keep all documentation and communications of the transaction

4.8 Right to remove listings

HIFICafe reserves the right to remove, without prior notice or compensation, any listing it considers fraudulent, misleading, illegal, or contrary to these Terms, without this implying any assumption of liability for content removed or maintained on the platform.
